Subscription Agreement

Welcome to Fuuse, a lightweight image synthesis tool designed to help you create creative group photos. This Subscription Agreement governs your purchase and use of subscription plans offered by Fuuse for unlimited access to the App’s image synthesis services. By purchasing or activating a Subscription, you agree to be bound by all the terms and conditions set forth in this Agreement, as well as our Fuuse User Agreement and Privacy Policy (both of which are incorporated by reference into this Agreement). If you do not agree to any part of this Agreement, please do not purchase or activate a Subscription.

1. About Fuuse Subscriptions

Fuuse offers auto-renewing subscription plans to provide you with enhanced access to the App’s core services. Unlike many subscription-based apps, Fuuse does not require you to create an account or provide any personal information (such as your name, email address, or phone number) to purchase or use a Subscription. Your Subscription is linked directly to your Apple ID, which is used to process payments and manage your subscription status—we do not collect or store any of your Apple ID details or personal information related to your subscription.

Subscriptions are designed to give you unlimited access to image synthesis features, along with additional benefits, as outlined in Section 2 below. All Subscription purchases are processed exclusively through Apple’s in-app purchase system, and we have no access to your payment information (such as credit card details), which is handled entirely by Apple in accordance with their own terms and privacy policies.

2. Subscription Benefits

When you activate a Fuuse Subscription, you will receive the following benefits for the duration of your active subscription period (subject to the terms of this Agreement):

2.1 Unlimited Image Synthesis: You may use the App’s AI image synthesis feature an unlimited number of times, with no restrictions on the number of group photos you can create. This includes uploading two portrait images and adding background images from your device’s photo library, camera, or the App’s built-in templates.

2.2 No Watermarks: All group photos synthesized while your Subscription is active will be free of any Fuuse watermarks. This allows you to use, share, or save your synthesized works without any branding or watermark overlays.

2.3 Priority Customer Support: Subscribers receive priority access to our customer support team. If you encounter any technical issues, have questions about the App, or need assistance with your Subscription, we will prioritize your inquiry and respond within 1 business day (compared to 2-3 business days for non-subscribers).

2.4 Access to All Future Updates: Your Subscription includes access to all future updates and enhancements to the App’s synthesis features, built-in templates, and gallery functionality, at no additional cost. We may add new features or improve existing ones from time to time, and all subscribers will have immediate access to these updates while their Subscription is active.

3. Subscription Plans, Pricing, and Payment

3.1 Available Plans: Fuuse offers multiple auto-renewing subscription plans, including weekly, monthly, and annual options. The specific pricing, duration, and details of each plan are displayed within the App at the time of purchase. We reserve the right to adjust pricing or add new subscription plans at any time, but any changes will not affect your current Subscription period—you will continue to receive the benefits of your purchased plan at the price you paid until the end of your current billing cycle.

3.2 Payment Processing: All Subscription payments are processed through Apple’s in-app purchase system. When you purchase a Subscription, you authorize Apple to charge the payment method linked to your Apple ID (e.g., credit card, Apple Pay, or other approved payment methods) for the subscription price. We do not collect, store, or process any of your payment information—this is handled entirely by Apple, and we have no access to your payment details.

3.3 Pricing Changes: If we adjust the price of a subscription plan, we will notify you of the new price at least 30 days before it takes effect. If you do not wish to continue with the new price, you may cancel your Subscription before the price change takes effect (see Section 5 for cancellation instructions). Your continued use of the Subscription after the price change takes effect constitutes your acceptance of the new price.

3.4 Introductory Offers: From time to time, we may offer introductory discounts or free trial periods for new subscribers. These offers are subject to additional terms displayed within the App at the time of sign-up. Introductory offers are only available to new subscribers who have not previously purchased a Fuuse Subscription. If you cancel a free trial before it ends, you will not be charged for the Subscription. If you do not cancel before the trial ends, your Subscription will automatically renew at the standard price, and Apple will charge your linked payment method.

4. Auto-Renewal Terms

All Fuuse Subscriptions are auto-renewing, meaning your Subscription will automatically renew at the end of each billing period (weekly, monthly, or annually, depending on the plan you purchased) unless you cancel the auto-renewal feature through your Apple ID settings. This ensures that you can continue to enjoy unlimited access to the App’s services without interruption.

4.1 Renewal Notifications: Apple will send you a notification before your Subscription renews, reminding you of the upcoming renewal date and the amount that will be charged to your linked payment method. The timing of these notifications is determined by Apple’s in-app purchase system.

4.2 Renewal Charges: On the renewal date, Apple will automatically charge your linked payment method for the next billing period’s subscription price. If the payment fails (e.g., due to an expired credit card or insufficient funds), your Subscription may be suspended until payment is successfully processed. We are not responsible for any failed payments, and it is your responsibility to ensure that your payment method is up-to-date and has sufficient funds to cover the renewal charge.

5. Subscription Cancellation and Refunds

You may cancel your Fuuse Subscription at any time, and the cancellation will take effect at the end of your current billing period. This means you will continue to have access to all Subscription benefits until the end of the period you have already paid for—no partial refunds will be provided for unused days in the current billing period.

5.1 How to Cancel: To cancel your Subscription, you must do so through your Apple ID settings (not through the Fuuse App). Here’s how to cancel: Open the Settings app on your device → Tap your Apple ID → Tap "Subscriptions" → Select "Fuuse" → Tap "Cancel Subscription" or "Cancel Free Trial" (if applicable). Follow the on-screen instructions to complete the cancellation. Once canceled, auto-renewal will be turned off, and you will not be charged for future billing periods.

5.2 Refund Policy: All Subscription purchases are non-refundable, unless required by applicable law. This includes purchases made in error, accidental subscriptions, or subscriptions that you no longer wish to use after activation. If you believe you have been charged incorrectly (e.g., double-charged) or have experienced a technical issue that prevented you from using the Subscription, please contact us using the contact information provided at the end of this Agreement, and we will review your request and work with Apple to resolve the issue if appropriate.

5.3 Suspension for Non-Payment: If Apple is unable to process your renewal payment (e.g., due to an expired payment method), your Subscription will be suspended until payment is successfully processed. During the suspension period, you will not have access to Subscription benefits (e.g., unlimited synthesis, no watermarks). Once payment is processed, your Subscription will be reactivated, and your billing cycle will continue as normal.

6. Subscription Eligibility and Usage

6.1 Eligibility: To purchase a Subscription, you must be at least 18 years of age. If your age is under 18 years old, you must have the permission of your parent or legal guardian to purchase a Subscription, and your parent or legal guardian must agree to this Agreement on your behalf. By purchasing a Subscription, you confirm that you meet these eligibility requirements.

6.2 Personal, Non-Commercial Use: Your Subscription is for personal, non-commercial use only. You may not share your Subscription access with any third party (e.g., friends, family, or colleagues), and you may not use the Subscription to create content for commercial purposes (such as advertising, marketing, or selling products) without our prior written permission. We reserve the right to terminate or restrict your Subscription if we reasonably believe you are sharing your access or using the Subscription for commercial purposes.

6.3 Device Limitations: Your Subscription is linked to your Apple ID, which allows you to use the Subscription on all devices associated with that Apple ID (in accordance with Apple’s terms of service). However, you may not use the Subscription on more than one device at the same time, and you may not share your Apple ID with others to provide them with access to your Subscription.

7. Subscription Termination

7.1 Termination by You: You may terminate your Subscription at any time by canceling auto-renewal through your Apple ID settings, as outlined in Section 5.1. Upon termination, your access to Subscription benefits will end at the end of your current billing period.

7.2 Termination by Us: We reserve the right to terminate or suspend your Subscription at any time, without prior notice, if we reasonably believe you have violated this Agreement, the Fuuse User Agreement, or Apple’s terms of service. Reasons for termination include, but are not limited to: sharing your Subscription access with third parties, using the Subscription for commercial purposes, uploading or creating inappropriate content (as defined in the User Agreement), or engaging in any activity that harms the App or its services.

7.3 Consequences of Termination: If your Subscription is terminated by us for a violation of this Agreement, you will not receive a refund for any unused portion of your Subscription period, and you will lose access to all Subscription benefits immediately. If you terminate your Subscription voluntarily, you will retain access to benefits until the end of your current billing period, and no refund will be provided for unused days.

8. Changes to the Subscription or Agreement

8.1 Changes to Subscription Benefits: We may modify, add, or remove Subscription benefits from time to time to improve the App and services. We will make reasonable efforts to notify you of any significant changes to Subscription benefits (e.g., adding a new benefit or removing an existing one) at least 30 days before the change takes effect. Your continued use of the Subscription after the change takes effect constitutes your acceptance of the updated benefits.

8.2 Changes to This Agreement: We may update this Agreement from time to time to reflect changes to the Subscription, App, or applicable rules. When we make significant changes, we will notify you by displaying a notice within the App or by other reasonable means (e.g., via Apple’s in-app notification system). The updated Agreement will take effect immediately upon notification, and your continued use of the Subscription after the notification constitutes your acceptance of the updated terms. We recommend that you review this Agreement periodically to stay informed of any changes.

9. Limitations of Liability

We strive to provide a reliable and high-quality Subscription service, but we cannot guarantee that the App will be error-free, uninterrupted, or free of bugs. We are not liable for any issues caused by the App or Subscription, including but not limited to: technical glitches, delays in image synthesis, loss of synthesized content, or temporary suspension of Subscription benefits due to payment issues or technical problems.

We are also not liable for any content you create or upload using the App while your Subscription is active, including any claims that your content infringes on the rights of others or violates applicable laws. You are solely responsible for your content and any consequences that may arise from its creation, use, or sharing.

The Subscription is provided "as is" and "as available," without any warranties of any kind (express or implied). We do not warrant that the Subscription will meet your expectations, be compatible with your device, or be free of viruses or other harmful components.

10. Integration with Other Agreements

This Agreement is in addition to, and incorporates by reference, the Fuuse User Agreement and Privacy Policy. If there is a conflict between this Agreement and the User Agreement or Privacy Policy, this Agreement will govern with respect to matters related to the Subscription, while the User Agreement and Privacy Policy will govern with respect to other matters related to the App and its services.
